Yes they are and so are the family courts!!!He Is in violation of the court order now.But there is a fine line when a biological parent takes the child Because In california Both parents have joint custody until the court determines otherwise.So technically If he's still in the state it's not Kidnapping.he would just be in violatation of the court order...which is serious but not as bad as kidnapping.But I'm sure he will just buy his way out of it also!!!I'm still waiting for my attorney's to get the court date. |

I don't care which state you live in, you have a right to see your daughter, there is no way to buy yourself out of that. Even if you don't have joint custody you have the right to know where she is and to see her. If the court is involved then they must know what his address is. I can't believe that you haven't seen her in three years and you don't know your rights yet. I find that hard to believe. You have joint custody but you would be arrested if you took your daughter away from him and didn't let her see him. You would be arrested first, and then you would go to court. If he is in violation of a court order he will be arrested. If this is a true story, you have enough reason to get full custody and a restraining order against him. |

Being "on your back" and "Paralyzed" is the condition you feel you have been in. Being not able to do anything much to get your daughter and custody, makes you just feel paralyzed, and him "over you", is quite literal as well as a pun. He IS lording it over you it seems. |
