      Men face jail for rape if women are 'too drunk'
      Men who have sex with drunken women will be at risk of being convicted of rape under new laws to be considered by ministers.
      The legal shake-up would mean a woman would be considered incapable of giving consent to sex if she had been drinking heavily.
      Police would be asked to carry out blood and urine tests on a woman who complained of rape to find out how much alcohol is in her body. They would then used "back calculations" to work out how drunk she was at the time of the alleged attack.
      A "drink and sex limit" would sweep away the confusion and controversy in the courts surrounding the issue of when a man accused of rape can claim he believed a woman gave her consent to sex.

      So, lemme get this straight, a guy and a girl go out drinking, both end up stone drunk and end up togeather.In the morning the woman decides she didn't wanna have sex and the man (who had no clue what he was doing last night) gets 18 years and gets on the sex offenders list then can never ever land a god job ever again.

      Does anyone else see problems with this?

      Alcohol messes with your ability to think and rationalize (obviously) So it makes perfect sense

      Though this might be a problem for ex-wives who want to get back at their husband or something, you never know what kind of loopholes new rules create

      I see a major problem with this
      currently women are quite opressed in most societies and there is msses of sexism
      but swinging to the other extreme will not benfit either.
      a women can convice a man to have sex with her when he is drunk
      and this is not rape?
      are we now to be persectuted for ahving a penis?

      Well, remember one thing: There are manipulative women out there(Surprise surprise eh? ). Immediatly having the man in the wrong is kinda unfair. Lets say the woman wanted to get back at some guy, gets him wasted, puts down a few herself but nothing too heavy and has her way with the wasted guy. Completely her choice. Has a couple more drinks while the guy is laying passed out, and then the next morning lets the police know that she was "raped." Police go to the guy, grab the guy, arrest him, charge him, yadda yadda. Guy was too drunk to really remember anything, or remember the fact that it was entirely the woman's choice because she didn't get wasted until after she had her way with him. Guy goes to jail, woman gets a nice sum of money for her troubles, when the guy was in reality, innocent.

      So yeah, theres a problem there.

      Hmm, doesn't freedom of choice apply here? Hasn't the woman the choice to decide how smashed she is going to get.

      Btw, although I am for freedom of choice here. No still means NO! But... if she is coming on to you like a drunken prom date, does that mean no?

      I guess it depends on how ethical the guy is. He should be gentleman enough not to take advantage to someone too far out of control without fearing the law.

      As far as I can see, the law only applies if the man is in complete control, while the woman is drunk/stoned.

      Thats Nuts, that law could easily ruin tons of guys lifes by manipulative woman, its already easy enough for a girl to change her mind and say she was raped and send us to jail.

      The way I see it. It will do more harm to the woman and be better for the male.
      Because the woman that get laid when you are that drunk would not have gotten laid otherwise.

      For the male, there is no sneaking out the back door inthe morning.

      Ok I wiould agree with the law if it worked the opposite way also
      if a man is drunk and a woman takes advantage then the law should also aplly

      For women, it's rape. For men, it's being friendly. If she's not a lard basket, I can't imagine a man ever pressing charges for rape in this case...

      This will help, but yeah, someone will abuse it eventually...

      It has been the law in all states for a long time that a woman who is absolutely smashed is not in a state to consent to sex. The problem men have is that an erection is assumed to be a "Yes" when a woman does not have an equivalent disadvantage. The law so far has only been concerned with women who are so blasted that they have no idea what is going on. I have seen women in that state where they babble nonsense and can barely keep their eyes open while some guys joke around about how they could have their way with her if they were like that. Going through with that is rape as far as I am concerned. I just hope the new law, wherever it is, doesn't have some crazy .08 limit or something insane like that. If I ever come across a territory with that law, I am going to pull out a breathalyzer before I try anything. I hope that won't destroy the moment.

      Good thing this is in the UK...otherwise I might actually care.

      As for the law in itself, I wouldn't worry too much. Who amongst us* cannot say that under these standards they haven't totally raped, and/or been raped by, women after a long drinking binge by both? Who amongst them?

      This law will have a very short longevity, till all the relatives to the politicians begin being accused of it, or simply when they realize that women can be crazy opportunistic money-grubbing whores who will definitely take advantage of a situation like this.

      Hey, if some fucked up whores out there are telling guys they are pregnant with their babies when they really aren't, how hard will it really be for them to just adhere themselves to this law in hopes of money/attention from daddy?
