Your argument is invalid. If I linked a pornsite here, that coincidentally had no images or improper material, but just trackers, but it did have an off-topic section where people would just talk normally, would it then be perfectly fine with you?
While it is true that these torrent sites offer both legal and illegal material, and it's true that it's up to the user to choose what features they will use, it still means that the site is clearly and purposely sharing illegal torrents.
from a legal stand point, there's no issues
but I'd have to mod the post for inappropriate content on a 15+ forum
(this forum has rules above and beyond any legal laws)

The point is the torrent by itself isn't illegal. It's only illegal if you use the torrent to download the copyrighted material.
Also, I think if you own the material it's not illegal either. I own an original copy of warcraft 3, got the original cd key to prove it, no one could possibly arrest or fine me for downloading the game.

youtube links are closer to "dodgy" as it's a direct link to streaming content
torrents are p2p
there's no direct linking to any content
There's a fair few games that plain work better if you torrent them
can't tell you how many think my wine install is a virtual CD emulator and refuse to install....
I need to crack them just to shut the installer up

I'm perfectly aware of that. The gun isn't illegal either. It's only illegal if you use the gun to shoot people. My point is, that forum administrators should be thinking further than what the law says. I might aswell go on and call everybody dipshits and whatnot and say that I'm entitled to do so, because of freedom of expression. Freedom of expression is however not a valid argument on forums, because of the fact that the forum is making its own rules, and one of them most likely is to not flame other members.
Somebody purposely linked to a website where you can acquire illegal material. Said link should be removed and the member be warned.
The Youtube argument is a shitty argument by the way. You might aswell say "Those guys are doing it, so we can too!".

I can see this leading to members testing the boundaries and posting heaps of torrent links
No matter what the legal status of linking to external sites, push too far and a shit-storm will ensue none-the-less
Don't forget, the issue was posting a link to the index page of torrent trackers
and not links to specific torrents
Test the boundaries and you may run the risk losing everything (including youtube) in an effort to rule consistently across the board

torrents are (afaik) undecided
use your common sense
and if in doubt, just use PM's or external communication channels (email / IM / IRC / whatever)
