      Photo of a girl I know...

      I took this picture of a little girl who lives on my street.
      I decided to post this because it is pretty much the one and only time my horrible camera didn't screw up the lighting or go blurry or SOMETHING.
      (I am very into photography, but all I have is a crappy digital Olympus camera.)



      She should be a model when she grows up.

      How old are you? That's a bit disturbing and she doesn't look too happy in that picture.

      It is a nicely lit and composed image.

      If, however, you don't have a model release from her parents, you are likely breaking the law in publishing that image on the internet. Even if it isn't illegal, it is wrong to publish any child's image without expressed permission.

      I'm sorry, but I'm deleting the link until I hear that you have written permission to have this out here.

      For my age, it's in my profile. Sorry you find it disturbing, it's not meant to be. She was actually perfectly happy to get her picture taken, but I told her not to smile for this shot. There are actually three others like this one where she IS smiling, but those ones didn't turn out very well.

      Thank you. It was very difficult to get because my camera flash kept going off when I didn't want it to.

      Oh sorry about that. I do have permission to put the picture on the web, because what I did NOT mention, is that this girl that 'lives on my street' is actually my little sister, and not only lives on the same street as me but in the same house. Should I still get written permission from my mom?

      Just out of curiosity, who exactly does this law apply to? Because my friend has posted photos of people she knows on Flickr without consent.

      A close friend of mine is a professional photog, which is how I know. The problem with posting a photo of a minor is that you can be held responsible under the privacy laws should the parents object. Anything that gets published in any form requires a model release to keep him from getting sued.

      Even without the above, in this day and age you don't go posting children's images around without permission. That's just a sad commentary on the world we live in.

      Oh yes, I don't post pictures of anyone without their permission. Even if it wasn't the law, that just wouldn't be right. I would be furious if I found a photo of my sibling on the internet and didn't know where it came from. (since I don't have kids i say sibling )

      I hope you enjoyed the photo though.

      Well, that's my mistake. I should have checked your profile before I assumed. It's just that "This is a little girl who lives on my street" sets off all kinds of red flags and alarm bells. You should seriously reconsider how you word things like that in the future. I'm glad that's cleared up.

      I seem to have a talent for making people think something other than what I mean... I'll have to work on that.

      Portraits are gay like that - It's hard to use the photos without consent of the main subjects. Sad because some of my best pictures are portraits, only I could never make them hugely public. Apparently, though, it's only illegal if there's a 'reasonable assumption of privacy' ie. in their house, car, etc.
