Its not so much that they don't exist but the fact that their not a ligitment threat to us.

They are killing our soldiers in Iraq, they have attacked several of our embassies, and they killed 3,000 American civilians on 9/11. Their publicly stated goal is to kill Americans wherever they can until we are all dead. Now imagine those people with WMD's they got from some government. Please explain how that could possibly not be a threat.
